General information
Space: The space on your website is yours to use. Constant monitoring should be done if you plan to allow FTP access to your website for uploading. You take full responsibility for every file located on your website. Hosting of illegal files, or anything not allowed in this TOS agreement will result in suspension of your account until future investigation is made.
Account data loss: We do regular backups of user and system data, but users are expected to keep local backups as well. You are ultimately responsible for backups of your data and we cannot be held accountable for the loss of data or income.
Account termination: We reserve the right to suspend or terminate your account for any reason, but primarily if we discover or suspect you are violating our TOS or our Acceptable Use Policy.
Misuse of resources: The misuse of resources, including but not limited to employing applications that consume excessive CPU time are prohibited.
Content: If you are unsure of whether certain content is allowed, please contact us before proceeding and we will be happy to provide further clarification.
Breaching service conditions: Exceeding purchased levels of service, including but not limited to disk allowances, bandwidth usages, CPU usage, RAM usage, slot or connection count and branding restrictions.
Prohibited data
The following items will not be tolerated and are only acceptable under the terms provided.
Illegal files: Pirated software, illegal audio/video files, cracks, and any other forms of copyrighted material that you are not legally allowed to use/distribute are all strictly prohibited.
Spam: Spamming is strictly prohibited and we take this matter very seriously. Anyone found spamming will be suspended without a refund. This includes: unsolicited commercial email, sending advertisements to multiple email addresses at one time (unless under the use of an opt-in mailing list), or using forced attacks via email. Furthermore, advertising any site hosted on our servers via unsolicited email will not be tolerated, even if the offending email does not pass through our servers.
Viruses: The following items are not allowed, nor will ever be allowed on our servers: hosting viruses, sending viruses via email, or allowing users to download files with trojans, viruses, or any harmful files. If you are looking to host this material, please look somewhere else.
Refunds
Termination of your account for violation of our TOS or Acceptable Use Policy (AUP) instantly voids any eligibility for a refund of any type.

Refunds will be given upon request to users who have purchased a web hosting package within 30 days of the purchase date with the following condition. If the bandwidth usage for the site exceeds 10% of the monthly allowance, the refund will not be granted.
Game servers and VPS services are not included in the 30 day money back guarantee.
Refunds will not be given for any web hosting packages purchased as part of a special offer unless a 30 day guarantee is otherwise stated on the information page for that specific offer.
Special Offers
Special offers and deals may be available from time to time. Specific details and terms are provided on the information page. You here by agree that before order that you have read and understood the terms stated on the specific offer page.
If a special offer consists of multiple components (for example a web hosting account and a domain name) then the price agreed is only applicable while all components remain active. Should the customer cancel any one component all remaining components will revert to their normal prices as stated on the web site.
Unless otherwise stated, special offers are for new orders only. Existing accounts may not be transferred automatically.
The above terms can be overridden by a sale representative or by specific terms on the offer page.
Cancellation
Cancellation will be granted for any of our products when requested by the customer no later than 14 days before the renewal date. An invoice for the next period of service will be issued 14 days before the end of the current period of service.
If a renewal invoice has been generated for a product then the customer must pay this unless the service was cancelled prior to the invoice generation.
For products that are covered by our 30 day money back guarantee where the product is still within the first 30 days of overall use, the above terms do not apply.
To submit a valid cancellation request a client must login to the client area with the correct account that holds the product in question. On the product configuration page is a cancellation request button which must be used. A support ticket may also be used to request a cancellation. No other form of communication is allowable for this process.
